REFUND POLICY

At Women on the Tools (WOTT) we keep our classes small to optimise your learning experience.  Any cancellations or transfers affect our ability to deliver these classes (and may even result in the cancellation of the course if we do not have sufficient numbers). 

Please consider your dates carefully prior to booking.

Course Cancellations and Refunds

  • If you cancel your course more than 7 days before the start date, you have the option to receive a full refund of the course fee or you may choose to transfer/reschedule to a new course date.
  • If you cancel your course between 2 and 7 days before the start date, you will receive a 50% refund of the course fee. You will not be able to transfer/reschedule to a new course date, but you are welcome to book into a new course. 
  • If you cancel your course with less than 48 hours’ notice before the start date, or if you do not show up for the course, you will not receive any refund of the course fee and you may not transfer to a new course date.  You are welcome to book into a new course at any time. 

How to Request a Refund or Reschedule 

To request a refund or reschedule your course, please contact us at info@womenonthetools.com.au or call us at 0401 791 050. 

We will endeavour to process your refund request within 7 business days and will notify you of the outcome.  We shall pay all refunds (excluding any credit card surcharges or other transaction fees) in the same form as the original purchase or to the same account or credit card used to make the original booking however may vary this method at our discretion. 

Exceptions and Disputes

We reserve the right to make exceptions to this refund policy in case of unforeseen events or circumstances beyond our control, such as natural disasters, health emergencies, or technical issues. We will evaluate each case individually and decide on the appropriate course of action.

If there is an inconsistency between this policy and the Australian Consumer Law (ACL), the ACL will prevail.  Further information about the ACL is available from the website of the Australian Competition and Consumer Commission.

Memberships Cancellations and Refunds

  • Your membership auto-renews on the date shown on your electronic receipt.
  • You can cancel your WOTT membership at any time, and you will continue to have access to the WOTT workshop facilities through to the end of your billing period. To the extent permitted by applicable law, membership fees are non-refundable and we do not provide refunds or credits for any partial membership periods or unused WOTT membership
  • To cancel your membership, we require a request in writing 2 weeks prior to the membership renewal date.   This applies to all monthly, quarterly and annual renewals.
  • Email info@womenonthetools.com.au  stating when your renewal is due and your wish to cancel.
  • You will forego any unused portion of your membership period should you wish to cancel earlier than the required 2 weeks.

Changes to the Price and Membership Plans 

We may change the fees for our membership plans and the price of our services from time to time. We will notify you at least one month before any price changes or changes to your membership plan will become effective. If you do not wish to accept the price change or change to your membership  plan, you can cancel your membership before the change takes effect.

MEMBERSHIP TERMS & CONDITIONS

These terms and conditions (the Terms) of Women on the Tools (ABN 88054144896) (We/Us) govern members’ use of our tools, equipment and facilities (Tools) at the Women on the Tools Workshop located at 2/8 Strang St, Beaconsfield and participation in workshops or tool programs run by us from various premises from time to time and any related services including online services (Services).

By accessing or using our Tools or Services, you agree to be bound by and comply with the Terms.

Application and Variation of Terms

We may vary these Terms, or any policy, procedure or guideline referred to within or associated with these Terms, at any time.

  1. Any changes will be effective immediately when published on our website, social media, our notice board(s) or as otherwise communicated by us to you.
  2. You agree to review the Terms and any other applicable policies, procedures and guidelines relating to our Tools and Services periodically and to be aware of any variations to the Terms.

Conditions

By using or accessing our Tools or Services, you confirm you:

  1. are over the age of 18;
  2. are in the necessary physical, mental and medical condition to be using our Tools or participating in our Services;
  3. will use our Tools carefully and diligently;
  4. will only use our Tools and Services according to the directions, policies or procedures as communicated by us (including by our directors, employees, representatives, volunteers or agents) or otherwise in accordance with the manufacturer’s policies or procedures;
  5. will wear suitable footwear, clothing and protective equipment (for example protective eyewear, closed-toe shoes, hair pinned or tied back) when using the Tools or Services;
  6. warrant your use of our Tools or participation in our Services does not infringe any applicable laws or regulations;
  7. acknowledge and understand that using our Tools or participating in our Services may be dangerous and may cause injury or even death to you or someone else;
  8. will notify us immediately if you observe that any of our Tools are damaged, defective or not in good working order;
  9. will take proper care of our Tools and not tamper with, modify or use our Tools other than in accordance with these Terms and as part of our Services;
  10. have completed our ‘Membership Application’ and have been accepted as one of our members;
  11. will participate in and comply with our safety induction and/or refresher training prior to using our Tools or participating in our Services;
  12. will only use our Tools marked “INDUCTION REQUIRED BEFORE USE” after receiving the required induction and/or supervision as part of our Services;
  13. will not smoke, operate a personal handheld device, consume any food or beverages while using our Tools or participating in our Services; and
  14. will not consume any alcohol, illicit substances, medication or any other substances that are likely to impair your motor skills prior to or whilst using our Tools or participating in our Services.

Property

  1. Any Tools or materials (for example policies, procedures, diagrams, marketing materials, branding and online content) (collectively, Property) that we provide to you as part of our Services are owned or licensed by us.
  2. You may only access and use our Property for non-commercial or personal use while accessing the Services. You are not  permitted to modify, sell, gift, dispose, or otherwise deal with any of our Property except to the extent permitted by law or where you have received prior written approval from us.
  3. If you damage (not in the reasonable course of use) or fail to return our Property to us when required, we may without notice to you, either draw down on any deposit monies paid by you to use and access our Services, seize our Property by any method permitted by law, and/or terminate your membership with us.

Limitation of Liability

  1. To the maximum extent permitted by law, you agree:
  2. to waive and exclude us from any rights or claims to compensation, damages, liability or any other costs (whether direct or indirect, special, consequential or any other damages of any kind) against us arising from, connected with, or related to your access to or use of our Tools or the Services.
  3. you are solely responsible for any injury, damage or loss caused or suffered by you or any other person arising from, connected with, or related to your use of our Tools or the Services (including but not limited to a failure to comply with these Terms) and we will not be liable for any such injury, damage or loss.
  4. We make no promises, guarantees, representations or warranties (except as imposed by law) about the condition, fitness for purpose, and/or suitability or condition of our Tools or our Services. To the maximum extent permitted by law, we will not be responsible to you or any third party for any direct or consequential loss suffered in connection with the use of the Tools or Services.
  5. This clause does not limit your rights under the Australian Consumer Law.

Release and Indemnity

To the maximum extent permitted by law, you:

  1. release us, our officers, employees, contractors, volunteers, representatives, and members against any loss, claims, demands, damages, proceedings, compensation, costs, charges, liabilities, expenses, consequential damages and indirect damages arising from any accident, loss or damage to property, or death or injury to you or to any person of whatever nature or kind arising from, connected with or related to our Tools or the Services; and
  2. indemnify us, our officers, employees, contractors, volunteers, representatives and members against any loss, claims, demands, damages, proceedings, compensation, costs, charges, liabilities, expenses, consequential damages and indirect damages of whatever nature or kind, arising from, connected with, or related to your use of the Tools or the Services.

Non-Waiver

  1. You understand that any delay or non-enforcement of any of our rights under these Terms does not mean we give up those rights and does not prevent us from enforcing our rights in the future.

Termination of Membership

  1. Your membership with Women on the Tools will renew at the end of the subscribed membership term unless terminated by you.
  2. You may terminate your membership early in accordance with our Membership Cancellation and Refund Policy.

Applicable Law

  1. These Terms are governed by the laws of Western Australia, Australia.

Severability

  1. If any clause within these Terms (or part of that clause) is deemed unlawful, void or unenforceable, then that clause (or part of that clause) will be severed (deleted) from these Terms and will not affect the validity and/or enforceability of the rest of the clauses in these Terms.

COURSES TERMS & CONDITIONS AND PHOTOGRAPHIC CONSENT

These terms and conditions (the Terms) of Women on the Tools (ABN 88054144896 ) (We/Us) govern course participants’ use of our tools, equipment, services and facilities (Tools) at the Women on the Tools Workshop located at 2/8 Strang St, Beaconsfield and participation in courses, workshops or tool programs run by us from various premises from time to time and any related services.

You agree to release, indemnify and hold Women on the Tools and their officers, representatives, employees, contractors and volunteers harmless against any loss, damage, harm, injury, liability or expense arising out of, or in connection with your use of the Tools and participation in anything facilitated by Women on the Tools, or in connection with anything owned or controlled by Women on the Tools.

You understand that all information provided by Women on the Tools, and its agents, are guidelines only and you will follow safety information provided.

You understand that you must always follow all safety guidelines and advice set out by tool manufacturers.

You agree to wear suitable footwear, clothing and protective equipment, You acknowledge that you do not have any physical limitations, medical ailments or other conditions which may limit or prevent you from participating in your registered courses safely.  If you believe at any time that your physical condition is unsafe whilst participating in the course, you agree to notify the instructor and agree to stop further participation in the course.

You also understand that Women on the Tools holds the right to ask participants to leave the Women on the Tools Workshop and premises, at any time, if they believe a participant is disruptive, disrespectful or is failing to follow instruction.  If this occurs, you will forfeit all payments already made and no refunds will be given by Women on the Tools in these circumstances.

By signing below you agree to the Terms and acknowledge you have read and accept the Women on the Tools “Refund Policy” regarding any cancellation of this workshop by you, or Women on the Tools.

Women On The Tools seeks permission to use images and video from our courses, workshops and events for promotional purposes (print and electronic). We will never use your image in a harmful way, and this material will be used only to celebrate and promote our community. All personal details will be kept confidential, however, we may use your first name in members groups. You can also choose to remain anonymous.
